A Municipal Order to be read for its first reading this coming Tuesday, July 7 at 7 p.m. involves the College Hill Local Historic District. According to the agenda for the meeting, Municipal Order No. 2010 - 138 reads as:
Municipal Order agreeing to the termination of ETA RHO Home Association of Sigma Nu Fraternity, Inc. Historic District Consent related to 1311 College Street (Filed 06/25/2010, 2:40 p.m.)
If passed, this Municipal Order would prevent the recently sold property at 1311 College Street from being included in the Local Historic District as directed by Consent of Sigma Nu in June 2004 and could potentially keep it out of the district forever. I urge you to voice your opposition to this municipal order. Below is the background on the creation of the local historic district and the original consent made in 2004 by the owners of the property in question.
When the City Commission approved creation of our district on June 29, 2004 (Ordinance BG2004-27) the Sigma Nu Fraternity had requested exclusion of their two properties at 1303 and 1311 College Street from the district. During the first reading of the Ordinance many spoke out in opposition to the exclusion of these two properties. Between the time of the first and second readings the ETA RHO Home Association of Sigma Nu Fraternity reached a compromise and consented to the inclusion of their property into the local historic district upon any future sale of the property when they moved to the "Greek Village". The Ordinance passed the second reading on June 29, 2004 in a 4-0 vote. The Consent was attached to the Ordinance as "ETA RHO Home Association of Sigma Nu Fraternity, Inc Historic District Consent" and has been in effect since then. If the properties were sold, all parties agreed that 1303 and 1311 College would enter the local historic district permanently.
In May of 2005, John and Alisa Carmichael purchased the property at 1303 College which subsequently became included in the Local Historic District as directed by the Consent.
Now, the property at 1311 College has been sold to the Phi Gamma Delta Fraternity (Deed Book/Page 1005/291) on June 1, 2010 and as such has entered into the College Hill Local Historic District. However, Municipal Order (2010-138) agreeing to the termination of ETA RHO Home Association of Sigma Nu Fraternity, Inc Historic District Consent has been filed and will have a first reading on Tuesday at City Commission at 7 p.m.
This Consent was very important at the time of the creation of the Local Historic District as it gave assurances that the properties would one day be included in the district when Sigma Nu made their planned move to the Greek Village.
